What is DCU Classified (the Service)?
Think of DCU Classified as an online marketplace through which individuals can buy, sell, and trade a variety of goods. (In the future we are hoping to open it up to be able to publicize community events.) DCU Classified is powered by Digital Federal Credit Union (DCU). 

How else is Digital Federal Credit Union (DCU) affiliated? 
DCU provides the resources to access and use the Service as well as terms and conditions pertaining to use of the Service. Even though DCU is simply powering this site, our name is connected to it and we are going to do our best to maintain a high level of integrity as we do with our financial products and services. The DCU Way (People Come First, Do the Right Thing, & Make a Difference), will always be a consideration. 

Is DCU Classified for profit?
No, DCU will not derive any direct profit from facilitating the Service.

How is DCU Classified used?
Very basically, individual sellers post a description of their goods in as much detail as they choose, along with pricing and contact information. DCU Classified will provide this information to the public in an easy to use format. Potential buyers can search the site and, if interested in a particular item, the Seller will be given the potential Buyer’s contact information. 

Isn’t the Seller’s Information usually just available on similar sites once someone has signed on?
It may be, but we feel this method will work as efficiently and still maintains the privacy of all involved as much as possible. But, this is a new and constantly evolving site. If something’s not working, we’ll fix it.

Will DCU contact the Buyer or the Seller for me?
No, all contact is strictly between the potential Buyers and Sellers. This includes inquiring about an item, determining method of payment, addressing any issues subsequent to a sale, etc. No exceptions. 

Is there anything that I won’t be able to attempt to sell on the site?
There are certain things that, due to the varied local and state rules and regulations governing their sale, we know we will not support the sale of through the site for example medication, weapons, games of chance, and the re-selling of event tickets (i.e. tickets to concerts, sporting events, etc.). The CONTENT section located within this Agreement provides guidance about postings and behaviors that aren’t acceptable.

In general though, consider the following before attempting to post:

●	Keep it CLEAN – no need to embarrass or disgust anyone
Your child and your grandmother should be able to read your posting without embarrassment on their part or yours!

●	Always be HONEST 
It is still the best policy and we expect if of all users.

●	Be RESPECTFUL
to the site and to the other users. Treat others as you would like to be treated.

If I have questions about the site – who do I contact?
We have provided “Contact Us” information on the site for any questions relating to the site. DCU’s Information Center will NOT be available to answer these questions. 

Does DCU provide any guarantees or endorsements in connection with the Service?
No, DCU does not provide warranties of any kind whatsoever, whether express or implied, in regards to goods or services publicized through the Service, nor does it make any claims as to the integrity of the Buyer/Seller. Buyer beware.

Why is DCU making this Service available?
We view this simply as another way to provide value to our members and potential members.  Chances are your junk is just someone else’s treasure.

DCU Classified AGREEMENT
 
Registration on and/or use of DCU Classified (the “Service”) constitutes the agreement of the registrant/user to the following, as applicable. Should you (the registrant/user) object to any term or condition, any guidelines, or any subsequent modifications thereto or become dissatisfied with the Service in any way, your only recourse is to immediately discontinue use of the Service.

GENERAL TERMS AND CONDITIONS

* You are at least 18 years of age;
* Sellers have a lawful right to sell the product or service they are advertising through the Service; 
* You are responsible for complying with any federal laws or regulations as well as any specific to the state in which you reside as pertains to the Service; 
* You agree to hold DCU, its agents, employees, successors and assigns, harmless for any and all resultant action derived from your use of the Service;
* You agree not to post, link to, or otherwise provide any information that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another's privacy, or is harmful to minors in any way; 
* You agree to access the Service solely for your own personal use and not on behalf of a third party or for commercial purposes.
* You agree that all contact pertaining to a potential sale is strictly between the prospective Buyer and Seller. This includes questions before, during and after a sale as well as any arrangements made regarding payment. 
* You agree that DCU may terminate your use of the Service for breaking the terms and conditions of this Agreement.

* That harasses, degrades, defames, intimidates or is hateful in nature toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, color, national origin, ethnicity, age, financial standing, handicap or disability;

* That violates any federal, state, or local law;
 
* That impersonates any person or entity, including, but not limited to, a DCU employee, or falsely states or otherwise misrepresents your affiliation with a person or entity.

* That includes personal or identifying information about another person without that person's explicit consent;

* That constitutes or contains  "affiliate marketing," "link referral code," "junk mail," "spam," "chain letters," "pyramid schemes," or unsolicited commercial advertisement;

* That constitutes or contains any form of advertising or solicitation if: posted in areas of the DCU sites which are not designated for such purposes; or emailed to DCU users who have not indicated in writing that it is ok to contact them about other services, products or commercial interests;

* That includes links to commercial services or web sites or contains information that is competitive in nature to DCU and/or its subsidiaries.

* That advertises any illegal service or the sale of any items the sale of which is prohibited or restricted by any applicable law.

Additionally, you agree not to:

* Contact anyone who has not agreed to be contacted by you;

* Use data obtained through the Service for any purpose other than that for which it was posted;

* "Stalk" or otherwise harass anyone;

* Collect personal data about other users for commercial or unlawful purposes;

* Use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from the Service;

* Post non-local or otherwise irrelevant Content, repeatedly post the same or similar Content or otherwise impose an unreasonable or disproportionately large load on our infrastructure;

* Attempt to gain unauthorized access to DCU's computer systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Service or the DCU website; or

* Use any form of automated device or computer program that enables the submission of postings on the site without each posting being manually entered by the author thereof (an "automated posting device"), including without limitation, the use of any such automated posting device to submit postings in bulk, or for automatic submission of postings at regular intervals.

* Frequently submit text not meant to be a classified ad.

ITEMS YOU CAN’T SELL ON DCU CLASSIFIED

There are certain things that, due to the varied local and state rules and regulations governing their sale, aren’t allowed to be sold through this site.

Here is a list of UNACCEPTABLE ITEMS:

1.	Knock offs of music, TV shows or movies. The "bootleg" movies, for example, are often made by guys who sneak a movie camera into a newly-released movie where presumably, they crouch behind a seat and make a crummy copy. There is a large production of these counterfeit items in Asia where US laws have no power.
2.	Software and computer games can likewise be copied and their sale is illegal by all US laws.
Naturally, the items above may be sold if you have a copy that you purchased legitimately and no longer want.
3.	The so-called "replica" market for handbags, designer sunglasses and clothing is definitely forbidden although these items are often sold in physical stores around the US. 
4.	Alcoholic beverage sales are not allowed although a beverage "container', especially those of wine, may be sold for its value.
5.	Cigarettes, cigars, smokeless tobacco or coupons for such items are not permitted on DCU CLASSIFIED although as with alcohol, tobacco containers may be.
The rules for collectible alcohol and tobacco containers are the same:
a.	The value of the item is in the collectible packaging, not in the wine/tobacco itself.
b.	The listing description should state that the package has not been opened, but that the wine/tobacco within is not for consumption.
c.	The collectible tobacco packaging must not be available at any retail outlet, and packaging must have a value that substantially exceeds the current retail price of that wine/tobacco product in the package.
d.	Sellers must take steps to ensure that the buyer of these collectibles is at least 18 years of age
6.	Firearms are strictly regulated by US law and may not be sold on DCU CLASSIFIED.
7.	Satellite and cable TV descramblers are forbidden by the Federal Trade Commission.
8.	Animals and wildlife products may not be sold, which includes stuffed birds and pets from endangered species. There are limited sales of ivory, tortoise shell, marine products and other items relating to animals. This area is quite complex and any would-be seller needs to thoroughly understand the various laws before getting involved in these sales.
9.	Event tickets may not be sold on DCU CLASSIFIED. Even tickets have state-by-state laws that make their sale complex. Some states, for instance, forbid anyone to make more than a few dollars in profit (or no profit at all) on the resale of tickets. For instance, Florida law states that tickets can be resold at no more than face value plus $1. In such states, these regulations apply only to buyers and sellers located in the same state as the actual event, meaning if a seller lives in Florida, he can't profit from ticket sales to Florida events. However, if he lives in any of the other 39 states, this restriction doesn't apply.
10.	Listing a catalog of items that a seller offers for sale is forbidden. The only catalogs legally sold on DCU Classified are collectible kinds, such as an old Sears Roebuck or Montgomery Wards catalog that is memorabilia and doesn't offer current merchandise for sale.
11.	Raffles and prizes are 100% prohibited. Such promotions are highly regulated and may be unlawful in many states.

DCU CLASSIFIED reserves the right to refuse other postings, even if they do not appear on this list, if the content in any way violates the spirit of the DCU CLASSIFIED mission.

PRIVACY PROTECTION AND FRAUD PREVENTION

You understand and agree that sending unsolicited emails using addresses obtained though the Service or through DCU computer systems is expressly prohibited.  Any unauthorized use of DCU computer systems is a violation of this Agreement as well as certain federal and state laws. Such violations may subject the sender and his or her agents to civil and criminal penalties. You agree not to post, email, or otherwise make available Content:

* That contains software viruses or any other computer code, files or programs designed to interrupt, destroy, limit or alter the functionality of any computer software or hardware or telecommunications equipment;

* That disrupts the normal flow of dialogue with an excessive amount of Content (flooding attack) to the Service, or that otherwise negatively affects other users' ability to use the Service; or

* That employs misleading email addresses, or forged headers or otherwise manipulated identifiers in order to disguise the origin of content transmitted through the Service or to mislead the receiver into believing they are in fact dealing with another entity.

DCU never asks for your private information such as your DCU account password, billing information or credit card in an email or on the phone. If you receive an email or phone call requesting that you provide personal account information such as your password or billing information, do not respond! DCU will NEVER solicit your account information in an email or over the phone. These attempts are from hackers in what is known as "phishing".  Phishing attacks typically use 'spoofed' emails and fraudulent websites designed to fool recipients into divulging personal financial data such as credit card numbers, account usernames and passwords, social security numbers, etc. Phishers work by hijacking the trusted brands of well-known banks, online retailers and credit card companies. If you are contacted by ANYONE asking you to provide DCU account information, or have received suspicious email, please contact DCU immediately.

LIMITATIONS ON SERVICE

You understand and agree that DCU may establish limits and other restrictions concerning use of the Service which may include but will not be limited to the number of days a post may remain accessible through the Service, the number of postings one individual may make to the Service, and the size of any postings and that DCU cannot be held accountable for the deletion of, refusal to post, or failure to timely post any Content.

TERMINATION OF ACCESS TO AND/OR USE OF SERVICE

DCU Classified may, in its sole discretion and without subsequent liability to you or a third party. delete or deactivate your account, block your email or IP address, or otherwise terminate your access to or use of the Service (or any part thereof), immediately and without notice, and remove and discard any Content within the Service, for any reason, including, without limitation, if DCU Classified believes that you have acted inconsistently with the letter or spirit of the Service. 

LIMITATIONS OF LIABILITY 

UNDER NO CIRCUMSTANCES SHALL DCU CLASSIFIED BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES (EVEN IF DCU CLASSIFIED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM ANY ASPECT OF YOUR USE OF THE DCU CLASSIFIED SITE OR THE SERVICE, WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF THE DCU CLASSIFIED SITE OR THE SERVICE, FROM INABILITY TO USE THE DCU CLASSIFIED SITE OR THE SERVICE, OR THE INTERRUPTION,SUSPENSION, MODIFICATION, ALTERATION, OR TERMINATION OF THE DCU CLASSIFIED SITE OR THE SERVICE.  SUCH LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR PRODUCTS RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE DCU CLASSIFIED SITE OR THE SERVICE OR ANY LINKS ON THE DCU CLASSIFIED SITE, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE DCU CLASSIFIED SITE OR THE SERVICE OR ANY LINKS ON THE DCU CLASSIFIED SITE.  THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. In some jurisdictions, limitations of liability are not permitted.  In such jurisdictions, some of the foregoing limitations may not apply to you.

MODIFICATIONS TO THE SERVICE AND THIS AGREEMENT

We reserve the right, at our sole discretion and without notification, to change, discontinue, modify or otherwise alter the Service or this Agreement at any time and that such shall become effective immediately upon posting to the DCU Classified site. You agree to review the Agreement frequently to ascertain what changes, if any, have been made. The current Agreement can always be located at the DCU Classified website.
